Booking Terms and Conditions
These Booking Terms and Conditions ("Booking Terms") apply to reservations at Mary E Luxury Apartments ("the Property", "we", "us", "our"). In these Booking Terms, "Guest" means the person who makes the reservation and every person staying under it, and "Management" means Mary E Luxury Apartments.
By making a reservation you accept these Booking Terms on behalf of everyone in your party. Please read them before you book. If anything is unclear, contact us and we will explain it before you commit.
1. Reservations and confirmation
A reservation is a request until Management confirms it.
A reservation is confirmed only when both of the following are true:
- Management has accepted the reservation; and
- the payment required by section 2 for the time of booking has actually been received.
Until the required payment has been received, a reservation is held as a provisional booking. A provisional booking is not a confirmed reservation and the apartment and dates are not guaranteed. We will tell you what is outstanding and how to pay it.
We will send written confirmation, with a booking reference, when a reservation becomes confirmed. Please check it and tell us promptly if anything is wrong.
2. Rates and payment
All prices are quoted in East Caribbean Dollars (XCD) unless we state otherwise in writing.
Payment required to confirm a reservation:
- If you book more than 14 days before arrival, 50% of the accommodation cost is payable at the time of booking, and the remaining 50% is due no later than 14 days before arrival.
- If you book 14 days or fewer before arrival, the full amount is payable at the time of booking.
Payment of the balance on arrival is not our normal policy and is available only where Management has agreed it in writing in advance.
We accept only the payment methods shown on our website at the time of booking. If a method is not listed, it is not available.
If a balance due under these Booking Terms is not paid by its due date, we will contact you. Where a balance remains unpaid after we have given you a reasonable opportunity to pay it, Management may treat the reservation as cancelled by the Guest and apply section 3.
Rates quoted are for the apartment, the dates and the number of Guests stated in the quotation. Adding a Guest, or changing the dates, may change the price.
3. Cancellation by the Guest
Please tell us as soon as possible if you need to cancel. Cancellation takes effect when we receive your notice.
Our standard cancellation terms are:
- 30 days or more before arrival: the deposit is refunded in full.
- 15 to 29 days before arrival: the deposit may be retained as the cancellation charge.
- 14 days or fewer before arrival: up to the full booking value may be charged.
- Failure to arrive without notice (no-show): up to the full booking value may be charged.
- Departure earlier than the booked departure date: unused accommodation is normally non-refundable.
These are the maximum amounts that may be charged, not automatic penalties. Management will apply them reasonably in the circumstances, and will tell you in writing what is being charged and why before any amount is retained or refunded.
Nothing in this section limits any right you have under the applicable law of Grenada that cannot lawfully be excluded or restricted, and where such a right applies it prevails over this section.
4. Changes to a booking
If you wish to change your dates, your apartment or the number of Guests, contact us as early as you can.
A change is subject to availability, and to any difference in rate between the original and the new booking. Your original booking remains in force until we have confirmed the change in writing.
Where a requested change cannot be accommodated, the original booking stands and section 3 applies if you then cancel.
5. Cancellation or material change by Management
We will not cancel or materially change a confirmed reservation except for good reason — for example where the apartment becomes unusable, where there is a safety concern, or where circumstances beyond our reasonable control prevent us from providing it.
If we do, we will tell you as soon as reasonably possible and will offer, so far as we are able:
- an alternative apartment or dates acceptable to you; or
- a full refund of all sums you have paid for the affected accommodation.
This section does not limit any additional right or remedy available to you under the applicable law of Grenada.
6. Arrival and departure
Check-in is between 3:00 pm and 8:00 pm.
Check-out is by 11:00 am.
Arrivals after 8:00 pm must be arranged with Management in advance so that somebody is available to receive you. Please tell us if your travel arrangements change significantly.
Early check-in and late check-out are available only where Management has approved them and subject to availability.
7. Occupancy
Only registered Guests may stay overnight, unless Management has approved an additional occupant in advance.
- One-Bedroom Apartment: maximum 3 Guests. The standard rate includes 2 Guests; a third Guest is subject to the applicable nightly supplement, which is shown before you book.
- Two-Bedroom Apartment: maximum 4 Guests.
The maximum occupancy of an apartment must not be exceeded. If your party changes, contact us before an additional person stays overnight.
8. Children, visitors, pets, smoking and noise
Children are welcome, and remain under the supervision and responsibility of their accompanying responsible adult at all times.
Visitors are welcome subject to reasonable Property rules. Visitors may not stay overnight unless Management has approved them as an additional overnight Guest, and occupancy limits always apply.
Pets may be accepted only by prior arrangement with Management. Please contact us before booking rather than arriving with an animal that has not been approved. Any rights or requirements applicable to assistance or service animals under the law of Grenada will be respected.
Smoking is not permitted inside any apartment. Please smoke only in designated outdoor areas.
Guests must avoid excessive or unreasonable noise and must respect the peaceful enjoyment of the Property by other Guests and by neighbouring residents, and must comply with the applicable laws of Grenada and any lawful direction of a competent authority.
Our House Rules form part of these Booking Terms and set out these expectations in full.
9. Care of the apartment, damage and cleaning
Please treat the apartment, its furniture, appliances, fixtures, equipment and keys with reasonable care, and report any damage, breakage or fault to Management promptly.
Where loss or damage is caused by a Guest or a member of their party, Management may seek the reasonable cost of repair, replacement or restoration. Normal fair wear and tear is not charged to Guests, and any amount sought will reflect the reasonable actual cost rather than a fixed or arbitrary penalty.
Please leave the apartment in a reasonable state of cleanliness on departure. Where cleaning requirements go substantially beyond normal accommodation turnover, Management may seek recovery of the reasonable additional cleaning cost.
10. Serious breach and termination
The Property must not be used for unlawful activity. Threatening, violent or seriously disruptive conduct, deliberate damage to the Property, or behaviour creating a material danger to another person is not permitted.
Management may take reasonable action to protect Guests, staff, neighbours and the Property, including contacting the appropriate authorities where necessary. A serious breach may result in termination of the stay where that is justified in the circumstances and permitted by the applicable law of Grenada.
11. Personal property
Please take reasonable care of your belongings and secure the apartment when you leave it unattended.
Management is not responsible for loss of or damage to a Guest's personal property except to the extent that the loss or damage results from our own negligence or breach of duty, or where responsibility cannot lawfully be excluded.
If you leave something behind, contact us and we will make reasonable efforts to return it to you.
12. Utilities and services
We aim to provide a continuous supply of electricity, water and any other service included in your booking.
Interruptions to a public supply, and to internet or television services, can occur and are not always within our control. We will take reasonable steps to restore an interrupted service or to mitigate its effect. Where an interruption within our control materially deprives you of accommodation you have paid for, we will make a reasonable adjustment.
13. Extended stays
Weekly and monthly rates may be available, typically between June and November. Availability and rates are confirmed at the time of booking.
For pricing purposes, a week means 7 nights and a month means 28 nights.
A long stay for holiday or short-term accommodation purposes is not a residential tenancy. Where a residential tenancy is intended, it is arranged separately under its own written agreement.
14. Complaints
If something is not right, please tell us as soon as reasonably possible so that we have the opportunity to investigate and put it right while you are still with us.
If you remain dissatisfied, write to us at the contact address below and we will respond.
15. Privacy
We handle personal information in accordance with our Privacy Notice, which explains what we collect, why, who we share it with and how long we keep it.
16. Website and electronic bookings
A booking made through our website is made electronically, and the acceptance recorded at the point of booking is evidence of your agreement to the version of these Booking Terms in force at that time.
We record which version of these Booking Terms you accepted, and when. Later changes to these Booking Terms do not alter a reservation already made.
We take reasonable care to keep our website accurate and available, but we do not guarantee uninterrupted availability.
17. Prices, currency and quotations
Prices are in East Caribbean Dollars (XCD) unless expressly stated otherwise. Where we show an amount in another currency, it is an indication only and the amount actually charged is the XCD amount.
A quotation is an offer and does not reserve an apartment or dates. Availability is confirmed only when a reservation is made and the required payment received. A quotation is valid until the expiry date shown on it.
An obvious error in a price or a quotation does not bind us. Where we discover one, we will tell you promptly and you may confirm at the corrected price or cancel without charge.
18. Invoices, receipts and payment records
We issue an invoice for amounts due, and a receipt for every payment actually received.
A receipt evidences a payment we have received. It is not evidence of a payment that is in transit or that has been initiated but not completed.
Invoices and receipts are kept as permanent records and are not altered after issue. Where a correction is needed, we issue a further document that records the correction and the reason for it.
19. Refunds
Where a refund is due, we will make it to the person who paid and, so far as practicable, by the method used for the original payment.
We will confirm the amount and the reason in writing before making a refund, and refunds are made within a reasonable time.
20. Accuracy of information
We take reasonable care that photographs and descriptions of the apartments are accurate and current.
Photographs of Carriacou and the surrounding area are provided to show the destination and do not represent the interior, the grounds or the view from any particular apartment unless we say so.
Minor differences may arise as furnishings and equipment are replaced.
21. Statutory rights and severability
Nothing in these Booking Terms excludes, restricts or overrides any right or obligation that cannot lawfully be excluded or restricted under the applicable law of Grenada.
Where any provision of these Booking Terms conflicts with a mandatory requirement of the applicable law of Grenada, that law prevails and the provision applies only to the extent permitted.
If any provision is found to be unenforceable, the remaining provisions continue in force.
22. Governing law
These Booking Terms are governed by the laws of Grenada, and the courts of Grenada have jurisdiction.
